Current status. The merchant messaging platform is in private development and controlled pilot preparation. No service is being sold to the public through this website today. These terms are published in advance so merchants, partners and platform reviewers can read them before onboarding opens.

1. Who these terms are between

These terms form an agreement between Bamaja Integrated Online Services Limited (RC 8992176), registered at 22 Afolabi Brown Street, Akoka, Lagos State, Nigeria ("Bamaja", "we"), and the business that creates an account on the platform ("you", "the merchant").

By creating an account or connecting a business messaging account to Bamaja, you accept these terms. If you are accepting on behalf of a company, you confirm you are authorised to bind it.

2. What the service does

Bamaja provides an AI-assisted sales and customer-service assistant that operates on a merchant's own business messaging channel. It answers customer enquiries from the merchant's catalogue, captures orders and enquiries, and escalates conversations to the merchant's staff.

The platform is a tool. It does not sell goods, hold stock, take payment on your behalf, deliver anything, or act as your agent in any transaction with your customers.

3. Your account

4. Your messaging account stays yours

Where you connect a WhatsApp Business Account, your phone number, Meta Business Portfolio and WhatsApp Business Account remain registered to you and under your control. Connecting grants us a limited authorisation to operate the assistant on your behalf. You may withdraw it at any time by disconnecting, and you keep your number and accounts.

You must also comply with the policies of any third-party messaging platform you connect, including its business messaging and commerce policies. Breaching those policies can result in the platform restricting your account, which is outside our control.

6. Your content and customer data

You keep ownership of your catalogue, prices, policies and customer records. You grant us the limited licence needed to host and process that content to run the service for you.

You are the controller of your customers' personal data. You are responsible for obtaining their consent to be messaged, giving them your own privacy notice, and handling their requests. We process that data as your processor, on your instructions, as set out in our privacy policy.

7. What the AI can and cannot do

Replies are generated automatically from the information you supply. Automated systems can be wrong, incomplete or out of date, particularly where your catalogue is out of date.

8. Fees

Pricing will be published before public onboarding opens and confirmed to you before any charge. Pilot participation may be free or discounted. Fees are quoted in Nigerian Naira and exclude any applicable tax unless stated. Third-party messaging platform charges, where they apply, are separate and passed through at cost or billed to you directly by that platform.

9. Availability and support

We aim to keep the service running reliably but do not guarantee uninterrupted availability. Maintenance, third-party outages, network failures and platform changes can interrupt service. During the pilot period the service is provided without a formal service-level commitment.

10. Suspension and termination

You may stop using the platform and close your account at any time. We may suspend or terminate an account that breaches these terms, poses a security or legal risk, or is required to be suspended by a third-party platform or by law. Where circumstances allow, we will give notice and an opportunity to fix the problem.

On termination, we delete your data in line with the retention periods in our privacy policy. You can export your data before closing your account.

11. Intellectual property

The platform, software, interface and branding belong to Bamaja. These terms grant you a limited, non-exclusive, non-transferable right to use the service while your account is active. Nothing here transfers ownership of our software to you, or of your content to us.

WhatsApp, Meta and related marks are trademarks of Meta Platforms, Inc. Bamaja is independent and claims no endorsement, certification or partnership.

12. Liability

To the fullest extent permitted by Nigerian law, we are not liable for lost profits, lost sales, lost data, business interruption or indirect or consequential loss. Our total liability for any claim arising from the service is limited to the fees you paid us in the three months before the claim arose, or ₦50,000 where no fees were paid.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or death or personal injury caused by negligence.

13. Indemnity

You will cover us against claims arising from your use of the service in breach of these terms, from the content you supply, or from your dealings with your own customers.

14. Changes to these terms

We may update these terms as the platform develops. We will post the new version here and change the effective date. For material changes affecting active merchants, we will give at least 30 days' notice by email. Continuing to use the service after the change takes effect means you accept it.

15. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. The courts of Lagos State have exclusive jurisdiction, though either party may seek urgent injunctive relief elsewhere. We will try to resolve any dispute informally first — write to legal@nigeriafaces.com.
